What is GDPR and how does it affect your marketing?
The General Data Protection Regulation (GDPR) came into effect across the UK and EU in 2018, and it remains the most important piece of data protection law that affects how businesses market themselves online. Despite being in force for several years, many small business owners are still unsure what it actually requires.
Put simply, GDPR governs how you collect, store and use other people's data. If you run a website, send marketing emails, use analytics tools, display cookies or store customer contact details, GDPR applies to you.

## Consent is the foundation
The most visible change GDPR brought was around consent. Before you send marketing emails, you need genuine, specific permission from the recipient. Pre-ticked boxes, implied consent from a previous relationship or buried privacy policy text do not count.
GDPR-compliant consent means:
- A clear, specific statement about what you are signing someone up for
- An active opt-in (a tick box that is unchecked by default)
- A record of when and how consent was given
- An easy way to withdraw consent (an unsubscribe link in every email)

## Cookies and tracking
When someone visits your website, your analytics tool (typically Google Analytics 4) places cookies on their device to track behaviour. Under GDPR, you must tell visitors what cookies you use, what data they collect and how to control them.
This is why virtually every UK website now shows a cookie consent banner. The banner must give visitors the choice to reject non-essential cookies, not just accept them. A banner that offers only "Accept All" without a working reject option is not compliant.
If you use Google Analytics 4 to measure your website's performance, you need a cookie solution that respects user choices while still collecting anonymised aggregate data for reporting. The Information Commissioner's Office (ICO) has published guidance on analytics and cookies that clarifies this balance.
## Data storage and security
GDPR also governs what you do with personal data once you have collected it. If you store customer names, email addresses, phone numbers or any other identifiable information, you must:
- Keep it only as long as you genuinely need it
- Secure it against unauthorised access
- Delete it when the customer asks or when the purpose expires
- Be able to tell a customer what data you hold about them on request (a Subject Access Request)
For most small businesses, this means having a clear data retention policy, using a reputable email platform (such as Mailchimp, ActiveCampaign or Klaviyo) and making sure your CRM or spreadsheet is not sitting unsecured on a shared drive.
## What happens if you get it wrong
The ICO can issue fines of up to GBP 17.5 million or 4% of annual turnover, whichever is higher. In practice, the ICO's enforcement approach is proportionate: most small businesses receive guidance and a warning for a first breach rather than a fine. But the reputational cost of a data breach or a formal ICO investigation is often higher than the financial penalty.
More importantly, customers are increasingly aware of their data rights. A business that handles data carelessly loses trust, and trust is hard to rebuild.
## The bottom line
GDPR does not stop you marketing your business. It simply means you must do it transparently, with proper consent and with respect for the data people entrust to you. A clean, compliant marketing operation is also a more effective one: engaged subscribers who actively opted in are far more likely to open your emails, click your links and become customers.
